Nevada Judge Issues Temporary Ban on Kalshi Operations

A Nevada court has issued a 14-day temporary restraining order against Kalshi, siding with state regulators over alleged unlicensed gambling violations.

Judge Jason Woodbury of the Carson City District Court has issued a 14-day temporary restraining order against Kalshi. The court accepted that the Nevada Gaming Control Board has a substantial likelihood of prevailing in its case against the platform. This decision allows state authorities to restrict the company’s operations while the legal dispute continues.

Regulation vs Innovation

The conflict centers on whether Kalshi’s contracts—which allow betting on events such as elections, sports, and entertainment outcomes—constitute financial instruments or a form of unregulated gambling.

Regulators argue these products fall under the category of a “sports pool” according to Nevada law and therefore require a specific license. Kalshi maintains that its activities are under the exclusive jurisdiction of the Commodity Futures Trading Commission (CFTC), which traditionally oversees derivative markets.

However, the court rejected this argument at this stage. The judge noted that while the issue of federal preemption is “nuanced and dynamic,” the weight of legal arguments currently favors state regulators.

Expanding Legal Pressure

The Nevada ruling is part of a broader wave of legal actions targeting Kalshi. The company faces lawsuits or investigations in several states, including Arizona, where criminal charges were brought for alleged unregulated gambling activities.

In Massachusetts, a court also temporarily banned the offering of sports contracts, though that measure was later appealed and partially overturned.
