August besagt, dass Liquid Staking-Vereinbarungen unter bestimmten Bedingungen keine Wertpapierangebote darstellen.<\/p>\n<h2>Liquide Staking-Tokens gewinnen an regulatorischem Boden<\/h2>\n<p>Der Leitfaden stellt klar, dass Staking Receipt Tokens (SRTs) \u2013 die Anspr\u00fcche auf eingesetzte Kryptow\u00e4hrungen und deren Belohnungen darstellen \u2013 keine Wertpapiere sind, wenn sie als einfacher Einlagenachweis strukturiert sind. Die SEC stellte fest, dass in F\u00e4llen, in denen die Anbieter nur administrative Funktionen wahrnehmen, ohne Entscheidungen \u00fcber den Einsatz zu treffen oder die Bedingungen f\u00fcr die Belohnung festzulegen, kein Anlagevertrag im Sinne des Howey-Tests vorliegt.<\/p>\n<p>Liquid Staking Tokens (LSTs), die h\u00e4ufig zur Aufrechterhaltung der Liquidit\u00e4t von On-Chain-Positionen verwendet werden, fallen unter diese Kategorie. Diese Token erm\u00f6glichen es den Inhabern, auf die Einsatzpr\u00e4mien zuzugreifen und gleichzeitig ihr Verm\u00f6gen f\u00fcr andere Finanzoperationen wie Handel oder Sicherheitenverwaltung zu verwenden, ohne die Einsatzposition aufl\u00f6sen zu m\u00fcssen.<\/p>\n<h2>Die Reaktion der Branche und die Auswirkungen auf die ETF<\/h2>\n<p>Nate Geraci, Mitbegr\u00fcnder von The ETF Institute, begr\u00fc\u00dfte die Entscheidung und bezeichnete sie als wichtigen Durchbruch f\u00fcr die Zukunft der Ethereum-Spot-ETFs. Laut Geraci k\u00f6nnen LSTs eine wichtige regulatorische H\u00fcrde \u2013 die Verwaltung der Liquidit\u00e4t innerhalb von ETF-Portfolios \u2013 l\u00f6sen, indem sie das Staking-Engagement erm\u00f6glichen, ohne Verm\u00f6genswerte zu binden.<\/p>\n<p>Lucas Bruder, CEO von Jito Labs, lobte den nuancierten Ansatz der SEC. Sein Team traf sich Anfang des Jahres mit SEC-Beamten, um zu erl\u00e4utern, wie LSTs innerhalb von ETFs funktionieren k\u00f6nnten, ohne gegen Wertpapiergesetze zu versto\u00dfen. Die Beh\u00f6rde betonte, dass die Leitlinien nur f\u00fcr Anbieter gelten, die innerhalb eng definierter administrativer Rollen arbeiten. Wenn ein Staking-Service mehr Ermessensspielraum erh\u00e4lt oder die in der Erkl\u00e4rung skizzierte Grundstruktur ver\u00e4ndert, kann er immer noch unter die Wertpapierregulierung fallen.<\/p>\n<p>Dar\u00fcber hinaus ist der Sekund\u00e4rhandel mit SRTs unter den beschriebenen Bedingungen zwar ebenfalls von der Registrierung ausgenommen, doch gilt diese Ausnahme nicht generell. Anbieter und Entwickler m\u00fcssen weiterhin sorgf\u00e4ltig pr\u00fcfen, ob ihre Modelle innerhalb der definierten regulatorischen Leitplanken bleiben.<\/p>\n<h2>Das gr\u00f6\u00dfere Bild<\/h2>\n<p>Diese Entwicklung baut auf einer wachsenden Zahl von SEC-Erkl\u00e4rungen auf, die einen verfeinerten Ansatz f\u00fcr die Krypto-Regulierung signalisieren \u2013 insbesondere, wenn es darum geht, die Kerninfrastruktur von den Investitionsmodellen zu trennen.
